Privacy Policy

This policy explains how Layer1 Auto, a division of Layer1 Data Services, Inc. (“Layer1 Auto,” “we”), 1645 N Spring St, Ste 210, Beaver Dam, WI 53916, collects and uses information on layer1auto.com and through our QR codes. We do not sell your personal information.

Information We Collect

Dealers	Name, email, phone, dealership name, city and state, dealer license number, AuctionACCESS number, inventory size, login details
Private sellers	Name, email, phone, login details
Listings	Vehicle details, VIN, photos, price, condition notes
Buyers who scan a QR code	The date and time of the scan. To avoid counting the same person twice, we keep a one-way code made from the IP address and browser for 10 minutes, then delete it. We do not look up or store the scanner’s location, and we do not store the IP address with the scan.
Buyers who message a seller	What they enter on the car page: name, phone and/or email, and their message
Marketplace waitlist	Name, email, phone (optional) and role (retail dealer, broker, private seller or buyer)
Early access list	Name, business name (optional), whether you are a dealer or private seller, phone (optional), email, number of cars (optional) and preferred language
Payments	Billing name, address and payment status. Card details go directly to Stripe; we never see or store full card numbers.
Account and purchase records	When you create an account, sign in, accept our Terms or make a purchase: the date and time, your IP address and browser, and the version of the Terms you accepted. We also keep a record of the listings you create, signs you print, QR code scans and buyer messages on your listings.

How We Use It

To run the Platform; create QR codes and listing pages; deliver buyer inquiries to sellers; verify dealers; process payments; show scan analytics; send account, billing and security emails; tell waitlist members when the marketplace opens; prevent fraud and abuse; respond to payment disputes and chargebacks; improve the Platform; and meet legal obligations. With your consent, we may send marketing emails, and you can unsubscribe anytime.

How Information Is Shared

Between users: A buyer’s message is sent to the dealer or seller of that vehicle. When a dealer offer or wholesale deal is accepted, both sides receive each other’s contact details. Wants Board posts are visible to verified dealers.

Payment disputes: If you dispute a charge with your bank or card issuer, we may share records of your purchase and use of the Platform (described in “Information We Collect”) with Stripe and your card issuer to respond to the dispute.

Scan analytics: Dealers and sellers see scan counts and scan dates and times for their own listings. They do not see who scanned unless the buyer sends a message.

Service providers that work on our behalf: Stripe (payments), DigitalOcean (hosting), Resend (email delivery), Google (website analytics), Wordfence (security), and the NHTSA VIN decoder (vehicle VINs only).

Partner links: Some pages may link to independent partner companies. If you follow a partner link, that partner’s own privacy policy applies. Layer1 Auto may earn a referral fee from partners. Partners are independent companies.

Legal reasons: When required by law, or to protect rights, safety and the Platform.

Business transfers: If our business is sold or merged, information may transfer to the new owner under this policy.

Cookies

We use cookies for login sessions, shopping cart and checkout, your language choice (English or Español), security, and basic analytics. You can block cookies in your browser, but some features, such as logging in and checkout, may stop working.

How Long We Keep It

• Account and listing data: while your account is active, and up to 90 days after you close it.
• Account and purchase records (Terms acceptance, sign-ins, purchases and the related listing activity): while your account is open and for up to 3 years after it closes, to handle payment disputes, taxes and legal claims.
• Scan and inquiry records: up to 24 months.
• Marketplace waitlist: until the marketplace opens and we have contacted you, or until you ask us to remove you.
• Early access list: until sign-ups open and we have contacted you, or until you ask us to remove you.
• Payment and tax records: as long as the law requires, typically up to 7 years.
• Security logs: up to 12 months.

Your Choices and Rights

You can view and update most account information in your dashboard. You can ask us to access, correct or delete your information, or to stop marketing emails, by emailing privacy@layer1auto.com. We will respond within 30 days. Residents of some states have additional rights under their state’s privacy laws, and we will honor them as required.

Security

We use encryption in transit (HTTPS), access controls, firewalls and security monitoring. No system is perfectly secure. If a breach affects your personal information, we will notify you as required by law.

Children

The Platform is not for anyone under 18, and we do not knowingly collect information from children.

Changes

We will post updates here with a new effective date, and email active users about significant changes.
